Terms of use

The short version: read the site, don't take it apart, and don't send us anything confidential through a web form.

Agreeing to these terms

These terms are between you and The Harmonyc Group LLC (“The Harmonyc Group”, “we”, “us”), a creative technology studio in New York City. Using theharmonycgroup.com means you accept them. If you do not, please stop using the site.

What this site is

It is a portfolio and a way to reach us. Everything on it is information about the studio and its work, published in good faith and accurate as far as we know at the time.

Nothing here is an offer, a quote, or professional advice, and nothing here forms a contract. Sending us a message does not make you a client and does not oblige us to take on your project. We work under a signed agreement, and only under a signed agreement.

What you may do

Read the site, share links to it, and quote short passages with credit and a link back. Search engines and other ordinary crawlers are welcome.

What you may not do

  • Copy, republish, or adapt the site’s text, design, imagery, or code as your own, or use any of it to train a model, without our written permission.
  • Take the typeface. Die Grotesk is licensed from Klim Type Foundry for use on this domain only. The font files are served so your browser can render this page, and that is the whole of the permission attached to them.
  • Try to reach the parts of the site that are not public. Some areas require a sign-in that belongs to the studio. Probing them, or using credentials that are not yours, is not permitted.
  • Interfere with the site or the systems behind it: no attacks, no flooding the contact form, no attempts to get around its limits, no bulk harvesting of anything published here.
  • Send anything through the form that is unlawful, deceptive, infringing, or malicious, or pretend to be somebody else.

What you send us

What you write in the contact form stays yours. By sending it you give us permission to store it, read it, and reply to it, which is all we want it for. How it is handled is set out in the privacy policy.

Please do not send confidential material through a web form. Until there is a confidentiality agreement between us, treat anything you send as unprotected, and send only what you would be comfortable having read without one.

If you send an unsolicited idea, concept, or proposal, we may already be working on something similar, and we are not obliged to keep it confidential, pay for it, or credit it. Nothing you send imposes an obligation on us that we have not agreed to in writing. This does not apply to work we do under a signed agreement, which is governed by that agreement.

Our work, and other people’s

The site, its design, its writing, and its code belong to The Harmonyc Group unless stated otherwise. The Harmonyc Group name and mark are ours.

Client work is shown with permission and remains the property of the clients it belongs to. Other companies’ names, marks, and material appear here to identify their owners and their projects. That is not a claim on them, and it does not imply that they endorse us.

The site as it stands

The site is provided as it is. We do not promise it will be available without interruption, free of errors, or free of anything harmful, and we do not warrant that everything on it is complete or current. To the extent the law allows, we exclude the implied warranties that would otherwise apply.

Liability

To the fullest extent the law allows, The Harmonyc Group is not liable for indirect, incidental, special, or consequential loss arising from your use of this site, including lost profits, lost business, or lost data. Where liability cannot be excluded, it is limited to one hundred US dollars.

Nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited. Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you.

Links to other sites

Where we link out, we do not control what is on the other end and we are not responsible for it. A link is not an endorsement.

Changes

We may revise these terms. The date at the top and the bottom of the page says when they were last changed, and the version published here is the one that applies.

Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute goes to the state or federal courts sitting in New York County, New York, and both of us agree to that venue. If you are a consumer somewhere whose law gives you the right to bring a claim locally, this does not take that right away.

If any part of these terms turns out to be unenforceable, the rest stands.
